2 – General terms and conditions for using the site and the services offered by Fixacouette :

Use of (hereinafter also referred to as the “site”) constitutes full acceptance of the following general terms of use. These conditions may be amended or supplemented at any time, and site users are therefore advised to consult them regularly.

The site is generally accessible to users at all times. SAS Fixacouette may nevertheless decide to interrupt accessibility for technical maintenance, in which case it shall endeavor to communicate the dates and times of the interruption to users prior to the intervention.

The website is regularly updated by SAS Fixacouette, which may also modify the Legal Notice at any time. Users are bound to the conditions in this Notice and are thus advised to consult them as often as possible.

3 – Description of the services provided :

The website aims to provide information about a product that facilitates the putting on and taking off of the duvet cover. It is designed to facilitate diverse means of contact: online, using the forms provided; by telephone; or at the physical address of the company.

SAS Fixacouette endeavors to provide the most accurate information as possible. The former cannot, however, be held liable for omissions, inaccuracies or lack of up-to-date information, whether owing to its own actions or to those of third-party partners that provide this information.

All information on the website is provided for informational purposes only, is non-exhaustive and is subject to change.

4 – Intellectual property and infringement :

SAS Fixacouette owns the intellectual property rights or the rights to use all items accessible on the site, including text, images, graphics, logos, icons, sounds and software.

In designing the site, SAS Fixacouette made use of stock photography, for which it has paid usage rights.

Any reproduction, modification, publication or adaptation of all or part of the site by whatever means or process is prohibited without the prior written consent of SAS Fixacouette.

All unauthorized use of the site or any part of the site shall constitute an infringement and will be prosecuted in accordance with Articles L.335-2 et seq of the French Intellectual Property Code (Code de Propriété Intellectuelle).

5 – Limitations to liability :

This site uses JavaScript technology.

The website shall not be held responsible for damage arising from use of the site. The site user agrees to access the site using recent equipment with an up-to-date browser and no viruses.

SAS Fixacouette shall not be held liable for direct and indirect damages that occur to the user’s equipment when accessing the website, and that result either from use of equipment that does not meet the specifications set out in Section 4 or from a bug or incompatibility.

6 – Management of personal data :

In France, personal data is protected under Statute no. 78-87 of January 6, 1978, Statute no. 2004-801 of August 6, 2004, Article L. 226-13 of the Criminal Code and the European Directive of October 24, 1995.

When accessing, the following data may be collected: the URL of intermediary links through which the user accessed, the internet service provider, and the user’s Internet Protocol (IP) address.

SAS Fixacouette collects only the personal information about the user required for certain services offered on the website. The user has full knowledge of providing this information, especially when entering text himself. The user is thus made aware whether providing such information is mandatory or optional.
In accordance with Articles 38 et seq of Statute no 78-17 of January 6, 1978 relating to information technology, files and freedom, all users have the right to access, rectify or challenge person data concerning him or her. The user must send written and signed request, enclosing a copy of the identity document with the holder’s signature and specifying the address to which the response should be sent.

No personal information about users of is published without the knowledge of the user, exchanged, transferred, assigned or sold to third parties on any media. Only in the event that SAS Fixacouette and its rights are bought would said information be transferred to the purchaser, which would be held to the same obligations for the storing and modifying of user data.

Databases are protected by the provisions of the Statute of July 1, 1998 transposing the European Directive 96/9 of March 11, 1996 on the legal protection of databases.

The website contains a number of hyperlinks to other sites, which have been set up with SAS Fixacouette authorization. SAS Fixacouette cannot verify the content of the sites visited via hyperlinks, and shall accordingly incur no liability for the latter.
